La aparición de un texto inédito de Jovellanos sobre la forma de organizar la presidencia de la Junta Central permite replantearse el protagonismo del ilustrado en la configuración del poder ejecutivo durante los primeros años de la guerra de la Independencia. Tras analizar la ubicación del documento, su datación y autoría, se mostrará el contexto en el que fue redactado. De resultas de este análisis, se concluye cómo muchas de las medidas relativas a la estructura de la Junta Central se debieron a Jovellanos, quien pretendía que dicho órgano pudiera ejercer un auténtico poder de dirección política, pero también que estuviese organizado de la forma más conveniente para que pudiera reflexionar sobre las reformas político-administrativas que debían realizarse una vez que se reuniesen las Cortes. A lo largo del estudio, mostraré cómo Jovellanos trató de que sus teorías políticas sobre la soberanía y la separación de poderes se viesen reflejadas en la forma de estructurar la Junta Central, pero también cómo alteró sus planteamientos iniciales, debido a los cambios operados en la convulsa situación política de España durante la guerra de la Independencia. Por otra parte, se pondrá de manifiesto cómo el diseño del poder ejecutivo interino obligó a Jovellanos a definir también las competencias de la futura Regencia, de las Juntas Provinciales y del propio monarca. Este trabajo emplea la metodología propia de la historia constitucional, analizando de forma integrada el pensamiento político, el contenido normativo y el desarrollo institucional. Para su realización se han empleado ante todo fuentes directas, muchas de las cuales son muy poco conocidas. The discovery of an unpublished document written by Jovellanos about the organization of the Presidency of the Junta Central allows for a reassessment of his relevance in the configuration of the executive power during the early years after the War of Independence. After explaining where the document was found, as well as confirming its authorship and when it was written, I will analyze the document’s context. The conclusion of this analysis is that many of the measures relevant to the structure of the Junta Central came from Jovellanos, who wanted said organization to be able to exercise genuine political power, yet to be organized in the most convenient way in order to be able to reflect upon the political and administrative reforms once the Cortes met. Throughout the study, I will show how Jovellanos tried to reflect his political theories on sovereignty and the separation of powers in the structure of the Junta Central, but also how he altered his initial beliefs due to the convulsive political situation in Spain during the War of Independence. Additionally, it will be shown that the blueprint of internal executive power obligated Jovellanos to also define the competencies of the future Regency, of the Juntas Provinciales and even of the monarch himself. This work employs a methodology typical to constitutional history, integrating an analysis of political thought, the contents of law and institutional development. In order to create this document, direct sources have been primarily used, many of which are relatively unknown. |
