En esta contribución se discuten cuatro aspectos de la magna obra de Luigi Ferrajoli, Principia iuris. Teoria del diritto e della democrazia: 1) las nociones de laguna y antinomia que configuran su concepción del sistema jurídico, 2) su análisis de los derechos constitucionales y de los conflictos entre ellos, 3) sus tesis acerca de la separación entre el Derecho y la moral y 4) el «constitucionalismo optimista», algo panglosiano, defendido por FERRAJOLI. Desde un amplio acuerdo en las cuestiones normativas, se ponen de manifiesto ciertas dudas sobre algunos de los fundamentos conceptuales de la obra. In this contribution, four aspects of Luigi Ferrajoli’s Principia Iuris. Teoria del diritto e della democrazia are discussed: 1) the notions of legal gap and legal contradiction which configure his conception of legal system, 2) his analysis of constitutional rights and the conflicts among them, 3) his theses about the separation between law and morals and 4) the «optimistic constitutionalism», rather panglossian, defended by FERRAJOLI. From a strong agreement in normative questions, this paper shows certain doubts about some of the conceptual foundations of FERRAJOLI’s work. |
