La Resolución A/RES/64/136 del 18 de diciembre de 2009 de la Organización de las Naciones Unidas declaró el año 2012 como el año internacional de las Cooperativas, sin embargo, aún hoy día las cooperativas son calificadas legalmente con una diversidad de términos que en la mayoría de los casos no responden a su propia naturaleza jurídica. En Venezuela, las cooperativas en su primera regulación legal, Ley de Sociedades Cooperativas, de 1910, eran calificadas como sociedades y así fueron incorporadas a la normativa del Código de Comercio de 1919. Para 1966, fueron reguladas por una Ley especial, Ley General de Asociaciones Cooperativas, destacando el cambio del calificativo legal, originando no solo un problema de terminología, sino también un problema en cuanto al régimen jurídico a aplicar. Situación que igualmente se ve reflejada en el ámbito del Derecho comparado, no hay designación unánime para ellas. Even today, however, cooperatives are legally authorized with a diversity of terms that, in the majority of the cases, do not correspond to their legal nature. In Venezuela, cooperatives in their first legal regulation, based on the 1910 Law of Cooperative Companies, were labeled as Companies and, as such, were incorporated into the norms of the Commercial Code in 1919. By 1966, they were regulated by a special law: the General Law of Cooperative Associations, highlighting the change of the legal description, originating not only a problem of terminology, but also a problem of what legal regime to apply. The situation is equally reflected in the area of comparative law. There is no common designation for them. The research leads to demonstrating that cooperatives belong to cooperative law, in that they are not associations, not companies; they are cooperatives. |
