Se analiza el funcionamiento y los retos que afronta el sistema interamericano de tutela de los derechos humanos, a la luz de la praxis institucional y del derecho internacional de los derechos humanos. La investigación se estructuró de la siguiente manera: a) se describen las atribuciones de la Comisión Interamericana y b) la interpretación de las funciones de la Corte Interamericana, incluida su naturaleza y régimen jurídico. Se concluye que el debate sobre el funcionamiento del sistema interamericano de tutela está abierto, en la expectativa de nuevas contribuciones y su reforma dependerá de la capacidad propia de sus organismos, especialmente de la Comisión, a fin de encontrar consenso en los Estados para el logro de los cambios necesarios. 125-141 semestral It is analyzed the operation and the challenges that the Inter-American system confronts about tutelage of the human rights, regarding the institutional practice and the international right of the human rights. The investigation was structured as follows: to) the attributions of the Inter-American Commission are described, and b) the interpretation of the Inter-American Court functions, including its nature and juridical regime. It is concluded that the debate on the operation of the Inter-American system of tutelage is open, in the expectation of new contributions and its reformation will depend on the capacity of its organisms, especially of the Commission, in order to find consensus in the States for the achievement of the necessary changes. |
