El derecho comparado es un instrumento de indudable importancia para el análisis de todas las instituciones jurídicas. En efecto, gracias a las soluciones y a las interpretaciones dadas en otros sistemas jurídicos, se puede realizar una apreciación sobre los puntos fuertes o débiles de esos sistemas y contribuir, si es el caso, a la evolución del sistema jurídico interno. Este trabajo de investigación, en grandes líneas, se concentra sobre el estudio de un sistema que ha sido siempre punto de referencia dentro de la evaluación de los sistemas de justicia administrativa extranjeros y, en especial, del sistema venezolano, como lo es el estudio del sistema francés. Un estudio sucinto sobre este ordenamiento jurídico nos
permite poner en relieve sus particularidades, la función o la especificidad que le es dada a los recursos administrativos en este Derecho y determinar si este instrumento, en el sistema francés, sirve para garantizar una protección real de los derechos y de los intereses de los administrados frente a la acción administrativa que afecte su esfera jurídica. 181-208 mgladys@ula.ve Comparative law is an instrument of great importance for the analysis of all juridical institutions. In effect, thanks to the solutions and interpretations given in other juridical systems, it may be carried out an analysis of strong and weak points of those systems and to contribute, if it is the case, to the evolution of the internal juridical system. This research work studies a system that has always been a point of reference within the evaluation of systems of foreign
administrative justice and, specially the venezuelan system, as it is the study of the french system. A short study on this legal system allows us to put emphasis on its features, the function or specification which is given to administrative recourses in this Law and determine if this instrument, in the french system, guarantees a real protection of rights and concerns of those who are administrated in front of the administrative action that affects the juridical sphere. |
