La constante evolución de las relaciones jurídicas y las necesidades de la práctica en el área
comercial, hacen necesaria el desarrollo y adaptación del ordenamiento jurídico. La
realidad del sistema arbitral requiere una pronta flexibilización de este sistema al ser el
mecanismo preferido por las partes para resolución de controversias de los negocios
jurídicos a los que se ven involucrados. Por este motivo, a través de la presente tesina se
pretende analizar y resaltar la necesidad de adaptar el régimen arbitral ecuatoriano
permitiendo la extensión del alcance del convenio arbitral a aquellas partes que, pese a no
haber convenido el arbitraje mediante un convenio escrito, su conducta presupone su
ineludible aceptación de esta jurisdicción para dirimir los conflictos, y que además se verán
directamente afectadas por el proceso arbitral que se lleve a cabo. No obstante, esta
apertura del sistema arbitral, como se observará en el trabajo planteado, debe llevarse a
cabo en casos excepcionales, con estricto apego al ordenamiento jurídico ecuatoriano. The constant evolution of the legal and practical necessities in the commercial area, require
the development and rearrangement of the legal system. The arbitration system actually
requires prompt flexibility as it has become the preferred mechanism for the parties to
resolve disputes of legal transactions in which they are involved. Therefore, through this
thesis we will analyze and highlight the need to adapt the Ecuadorian arbitration scheme
allowing extension of the scope of the arbitration agreement to parties who, despite not
having agreed to arbitration by a written agreement, conduct presupposes its inevitable
acceptance of this jurisdiction to settle disputes, and that will be directly affected by the
arbitration process conducted. However, this opening of the arbitration system, as will be
seen in the proposed work, must be done in exceptional cases, strictly in accordance with
Ecuadorian law. |
