La eutanasia puede estudiarse desde diferentes campos del conocimiento. Este trabajo
sin embargo, realiza un análisis limitado al ámbito jurídico. En la eutanasia convergen al
menos dos derechos fundamentales: la libertad y la vida. Esto justifica que el tema sea
abordado desde la teoría de los Derechos Humanos. Partiendo de un análisis de cada uno de
los derechos involucrados en la eutanasia y cuál es la obligación del Estado frente a cada
uno de ellos, esta investigación concluye que en la práctica eutanásica prevalece la
obligación del Estado en proteger la vida biológica. El Estado al verse obligado a tutelar el
derecho a la vida en la eutanasia debe abstenerse de aplicar la eutanasia a los Seres
Humanos bajo su jurisdicción así como no tolerar que particulares apliquen la eutanasia,
previniendo esto por medio de la legislación y adoptando medidas en torno a educar sobre
la ilicitud de la practica eutanásica y educando positivamente sobre el valor de la vida
humana y su estrecha relación con la dignidad humana intrínseca. Euthanasia can be approached from different branches of knowledge. However, this
investigation approaches euthanasia from a legal context. Euthanasia is about the
convergence of at least two mayor human rights: freedom and life. This justifies the theme
being approached from the legal area. Parting from an analysis of the main rights involved
in euthanasia, this investigation concludes that in euthanasia the obligation of the State
regarding human right to life prevails. The State under its obligation of protecting human
right to life must not apply euthanasia to Human Beings under its jurisdiction, and also not
tolerate that third parties apply euthanasia. In order to comply with its obligation, the State
has to legislate in order to prohibit euthanasia and needs to adopt measures to educate the
people in relation to the unlawfulness of euthanasia and educate positively about human
life’s value and its relationship with intrinsic human dignity. |
