El Ecuador como miembro de la Organización de los Estados Americanos ha
contraído ciertos compromisos respecto a los derechos humanos contenidos en
instrumentos internacionales, tales como la Carta de la Organización de los Estados
Americanos, la Declaración Americana de los Derechos y Deberes del Hombre, la
Convención Americana sobre Derechos Humanos, entre otros. La Comisión
Interamericana de Derechos Humanos es el órgano de la Organización de los Estados
Americanos encargado de la promoción y protección de dichos derechos humanos, si
llegase a existir una violación o una situación que ponga en riesgo un derecho humano,
ésta le emitirá recomendaciones al Estado miembro. Dichas recomendaciones en
principio no tienen obligación jurídica de cumplimiento, sin embargo, en virtud de su
naturaleza y su valor jurídico dentro de la Constitución del Ecuador deberían ser
cumplidas por el Estado ecuatoriano.
El primer capítulo explica las competencias y estructura de la Comisión
Interamericana de Derechos Humanos y describe brevemente sus antecedentes
históricos. El segundo capítulo busca clarificar los deberes y obligaciones de los
Estados respecto al Sistema Interamericano de Derechos Humanos y algunos
instrumentos internacionales. El tercer capítulo reconoce el rol de la Comisión
Interamericana de Derechos Humanos, de la Organización de los Estados Americanos,
de la Corte Interamericana de Derechos Humanos y de la sociedad civil para lograr el
cumplimiento de las recomendaciones de la Comisión. Finalmente, el cuarto capítulo
presenta un análisis del tratamiento de dichas recomendaciones en la Constitución
ecuatoriana, acompañado de casos ejemplificativos. Ecuador as a member of the Organization of American States has made certain
commitments regarding human rights contained in international instruments such as the
Charter of the Organization of American States, American Declaration of the Rights and
Duties of Man, American Convention on Human Rights, among others. The Inter-
American Commission on Human Rights is the organ of the Organization of American
States responsible for the promotion and protection of such rights.
This organ will issue some recommendations to the States members, if there is a
violation or a possible violation of a human right. These recommendations in principle
have not legal obligation to comply. However, because of their nature and legal status
within the Ecuadorian Constitution should be fulfilled by the State.
The first chapter explains the competences and the structure of the Inter-American
Commission on Human Rights and a brief description of its historical background. The
second chapter is trying to clarify the duties and obligations of States regarding the
Inter-American System of Human Rights and several international instruments. The
third chapter recognizes the role of the Inter-American Commission on Human Rights,
the Organization of American States, the Inter-American Court of Human Rights and
the civil society to achieve the compliance of the recommendations. Finally, the fourth
chapter describes the analysis and the treatment of the recommendations in the
Ecuadorian Constitution, accompanied by some illustrative cases. |
