Descripción: Los seres humanos, para poder realizarnos como personas, gozamos de derechos subjetivos o facultades que nos permiten hacer lo que mejor nos convenga a nuestros intereses y plan de vida, y que están protegidas y amparadas por el ordenamiento jurídico. Se dice entonces que cualquier acto que se ejecute en ejercicio de estas facultades, es lícito y no comporta responsabilidad alguna, pues el propio ordenamiento jurídico lo avala. Sin embargo, estas facultades, se desenvuelven en un medio donde hay otras facultades jurídicas de otros sujetos, que son así mismo dignas de tutela jurídica, razón por la cual estas facultades no pueden ser ejercidas irresponsable e ilimitadamente, sin cumplir su función social, sin tener interés digno, y causando daños injustos a terceros.
Human beings possess Rights or faculties that allow them to do what is best to their interests and life plan. These Rights are in fact protected and sheltered by the lawful or juridical system. With this being, it is said that any act or behaviour that has its origins or justification in these Rights, is totally legal and licit, ergo it will not involve any kind of responsibility to its owner because the legal system vouches it. Nevertheless, these faculties unfold in a social world, where there are other rights that are as well protected by the law. This is why these legal faculties should not be exercised unlimitedly, selfishly and irresponsibly, without fulfilling the goal they were meant for, without persecuting a worthy interest, and furthermore, being harmful toward others. With this, the Abuse of Rights or misusage of faculties, as a new figure has emerged as a Lawful Principle.
