Descripción: Se pretende determinar el alcance del artículo 402 de la Constitución del Ecuador 2008, referente a los derechos colectivos de propiedad intelectual. Dicho texto legal dispone que se prohíbe el otorgamiento de cualquier tipo de derechos sobre conocimientos colectivos, aseveración que es contraria a cerca de toda legislación, tanto nacional como internacional, vigente. Se analiza en detalle los diferentes cuerpos legales relacionados al tema, con lo que se concluye, tras una ponderación, sobre la eficacia del artículo constitucional. Las incongruencias que se expresan en el artículo 402 de la Constitución se evidencian clara y notoriamente, lo que supone un debate relevante al tema.
We pledge to determine the scope of the Article 402 of the 2008 Constitution of Ecuador, concerning the collective rights of intellectual property. That statute prohibits the granting of any rights regarding collective knowledge, a claim that is contrary to nearly all legislation, both national and international. We analyze in detail the various legal bodies related to the topic, and conclude, after analyzing in detail, on the effectiveness of the constitutional article. The inconsistencies that are expressed in the Article 402 of the Constitution are clear and well evidenced, which raises a heated discussion relevant to the topic.
