Este trabajo pretende dar una idea amplia al lector de la necesidad actual de implementar un modelo de mediación entre culturas denominado mediación intercultural, que permita resolver los conflictos que se presenten entre los ciudadanos ecuatorianos y ciudadanos extranjeros que posean otra cultura distinta a la nuestra. En este sentido el trabajo inicia determinando la importancia de la mediación en el Ecuador, sus bondades y la explicación del procedimiento y de su naturaleza con lo que se puede observar la conveniencia de su aplicación en nuestro sistema jurídico combinados con una idea general del concepto de cultura, sus características y elementos que permitirá hacer que el lector realice un análisis interno y pueda extraer sus propias conclusiones de la diversidad de culturas. Una vez sentadas las bases de lo que significa este método innovador para la administración de justicia, en el segundo capítulo se procede a explicar el significado de la interculturalidad y las razones por las que se origina al momento de que se generan focos de inmigración en las sociedades receptoras, en nuestro caso la ecuatoriana. Se explica el fundamento jurídico del respeto que debe existir a las culturas y a la interculturalidad que inevitablemente se genera basado en principios constitucionales como la ciudadanía universal, el principio del derecho a la diferencia, el principio del diálogo, el principio de la unidad en la diversidad adicionalmente se explican las diferencias conceptuales entre multiculturalismo e interculturalismo y la conveniencia y fundamento del segundo. En el tercer capítulo se explica el fenómeno de la inmigración, observando que es uno de los generadores de la interculturalidad tratada en el capítulo anterior. Se analiza la necesidad de aplicación de políticas inmigratorias en el Ecuador y el control correcto de flujos inmigratorios dentro del país. Se realizó un análisis de las causas que generan este fenómeno y que han sido estudiadas por diversos expertos. Dentro del último capítulo se analiza tanto el modelo de mediación intercultural, bondades, elementos, modelos propuestos por ciertos autores y el procedimiento inherente a su naturaleza, así como también la propuesta de creación de un centro de mediación intercultural en el Ecuador. The thesis aims to demonstrate the readers the need to create and implement a new mediation model between cultures, called Intercultural Mediation. The proposed model will allow to clear up conflicts which can come out between Ecuadorian citizens and foreigners. First of all, the thesis begins showing the mediation process importance, its kindness, and the explanation of its procedures which will help the readers to assess how convenience is to apply it within Ecuadorian legislation. Also, in the first chapter of this thesis, the reader can find some definitions related to the word culture in addition to its elements and characteristics that will allow the readers to make a correct analysis in order to draw their own conclusions about the thesis topic. Once the readers have understood what the first chapter was about, the importance of this innovative method for Ecuadorian legislation, the second chapter proceeds to explain the readers the meaning of the word interculturality and the reason why this phenomenon shows up in societies which have sources of immigration. For instance, the reader could analyze the interculturality between Ecuadorians and foreign immigrants. In addition, chapter two pretends to provide the readers the legal grounds in order to understand why cultures and the interculturality phenomenon between them must be respected. The legal grounds are called Universal Citizenship right, the right to be different, the dialogue rule, and the unity in diversity. Moreover, the readers will find the differences between multiculturalism and interculturalism. The third chapter talks about the phenomenon of immigration explaining the readers why it generates the interculturalism phenomenon studied in chapter two. Within chapter two the readers can find out some arguments about the need to implement public immigration policies to control the immigrants groups in Ecuador and the phenomenon´s causes. Finally, last chapter leads the readers to analyze the Intercultural Mediation Model, its kindness, elements, its rules, and policies. Therefore, the readers will find out some experts’ definitions and the proposed to establish a center for Intercultural Mediation in Ecuador. |
