La Sala Constitucional de Venezuela declaró inejecutable una sentencia de la Corte Interamericana de Derechos Humanos, ocasionando así, el incumplimiento a un documento emanado de un Organismo Internacional que prevalece sobre la Constitución, ya que posee derechos de mejor calidad que los contemplados en la Carta Constitucional, además que es de obligatorio cumplimiento para quienes ratificaron la Convención Americana de Derechos Humanos, una errónea interpretación de dicha Sala perjudicó a las victimas al momento de ejercer sus derechos derivados del mencionado documento, esto creó una falencia del Sistema Interamericano de Derechos Humanos. El análisis de este hecho resulta necesario porque esto ha creado un precedente jurídico de trascendencia en los países miembros, y para tratar de evitar una similar eventualidad se deben tomar correctivos en los mecanismos usados por la Corte Interamericana de Derechos Humanos en relación a su potestad de Supervisar el cumplimiento de sentencias y otras decisiones del Tribunal. Venezuela's Constitutional Court declared unenforceable a judgment of the American Court of Human Rights, thereby causing the failure to a document issued by an international organization that prevail the Constitution, as it has rights of better quality than those provided for in the Constitutional Charter, also it is mandatory for those who ratified the American Convention on Human Rights, an erroneous interpretation of that Court victims hurt when exercising its rights under that document, this created a shortcoming of the Inter American Human Rights System. The analysis of this fact is needed because this has created a legal precedent for transcendence in member countries, and to try to prevent a similar event should take corrective in the mechanisms used by the Inter-American Court of Human Rights in relation to its power of monitor compliance with judgments and other decisions of the Court. |
