Este trabajo t rata sobre el control de operaciones de concentración que se producen dentro de un mercado, sobre los diversos actos que realizan los agentes económicos en la trasferencia de bienes y servicios. Para poder l legar a establecer que conductas son perjudiciales para el interés particular, tanto de las empresas como de los consumidores es necesario conocer, en principio, algunos conceptos básicos del Derecho de Competencia, así como también las conductas que se consideran restrictivas a la competencia. Se llegara a comprender como ha ido evolucionando esta materia tanto en legislaciones internacionales como en nuestra normativa, con la expedición de la Ley Orgánica de Regulación y Control de Poder de Mercado, así como el beneficio que con lleva la promulgación de dicha Ley. Durante el desarrollo de este trabajo de titulación universitaria se ha recogido las diversas teorías que establece la doctrina, respecto de lo que representa las concentraciones, la toma de control, las diversas formas de l legar influenciar dentro de las decisiones de una empresa, para de esta manera poder aclarar todos estos actos que son importantes para la buena aplicación de esta nueva Ley en nuestro país, sirviendo tanto a quienes administran justicia como abogados en libre ejercicio, para que puedan despejar sus dudas. De igual forma las aclaraciones que se dan durante el desarrollo de este trabajo sobre las diversas conductas que se dan dentro de un mercado, buscan generar mayor seguridad jurídica tanto a los agentes que intervienen en el mercado como a quienes invertir en nuestro país. This work is about the control of operations of concentration that occur within a market, on the different actions performed by economic agents in the transfer of goods and services. In order to establish which behaviors are detrimental to the interests of both businesses and consumers, is necessary to know, in principle, some basic concepts of Compete it on Law, as well as behaviors that are considered rest reactive to compete it on. There’ll be full understanding about owc competition haze l vet in both international law and in Ecuadorian law, with the creation of the Organic Law for the Regulate ion and Control of Market Power, and the benefit that represents the enactment of this Law. During the elaboration of this university degree work, different theories established by the doctrine have been collected, about what concentrations stand for, the control takeover, the different ways of reaching influence on the decisions of a company, so that all of these acts that are important to the successful implementation of this new law in our country could be clarified, serving both those who administer justice as lawyers in free exercise, so they can answer your questions. The explanations given during the course of this work on the different behaviors that occur within a market, aimed at creating greater legal certainty for the agents involved in the market and also for those who invest in our country. |
