La competencia desleal es uno de los grandes factores que pueden destruir a un mercado; dentro del mercado farmacéutico se encuentran productos nuevos que para su comercialización ha sido necesario presentar Datos de Prueba a la autoridad competente, estos Datos de prueba es un proceso largo y oneroso de la recopilación de información acerca de estudios o pruebas pre-clínicos y clínicos necesarios para la creación de un producto seguro y efectivo el cual es fundamental proteger, pues pueden existir terceras personas que deseen apoderarse de la información recopilada sin la autorización del titular, para la creación de otro producto de menor precio, de menor y mayor calidad, llegando de esta manera a constituir competencia desleal, ya que esta circunstancia será una actividad ilícita de orden comercial, empresarial o profesional, que persigue la captación de la clientela ajena y el aumento de posibilidades comerciales en el mercado por medio de reñidos con la buena fe. Es por tal razón que será necesario en el Ecuador crear y aplicar normas que permitan el buen funcionamiento del mercado farmacéutico sin distorsionar a la libre competencia Disloyal competition is one of the major factors that contribute to destroy a market; within the pharmaceutical offer we find new products that necessarily need to present their Data Proof to the authority in order to be able to merchandise their products to the customers. The process to obtain the Data Proof is very costly as complex, the reason is the compilation of information about studies or necessary pre-clinical and clinical tests for the creation of a safe and effective products, which are fundamental to protect that make this process to be very exhaustive. The reason to obtain a Data Proof is to protect the product from any third party that may be interested on seizing the information compiled by the applicant, obviously without the authorization of the holder, for the creation of another product offered in a cheaper price that may contain minor and major quality form the product offered by the creator. Said this, it constitutes a way of disloyal competition not to demand the Data Proof from the authority to the applicant. By not requesting the Data Proof it generates an illicit activity from third parties by creating a misleading attitude towards commercial order, enterprise confusion and unethical professional conduct. It is for such reason that it is necessary in Ecuador to create and apply norms that allow the good operation of the pharmaceutical market without distorting the free competition. |
