El desarrollo de esta tesis comienza básicamente con el estudio y análisis de la normativa constitucional vigente en el Ecuador que garantiza y reconoce a la seguridad como un deber y un derecho fundamental que tiene el Gobierno Central para con sus habitantes con el fin de que la ciudadanía desarrolle sus facultades de manera íntegra, pacífica y segura donde se garantice el bien común. Luego del analizar la Constitución de la República se analizarán y estudiarán los procedimientos para la constitución de compañías de responsabilidad limitada para que luego de esto, se pueda entender de mejor manera cuales son los requisitos, autorizaciones y permisos que exige la ley de Vigilancia y Seguridad Privada y su respectivo reglamento para la legal constitución de Compañías Limitadas de Seguridad Privada en el Ecuador. Superado el tema de la constitución de las organizaciones de seguridad privada, se estudiaran cuáles son los organismos que controlan y regulan esta actividad con el fin de supervisar y controlar el funcionamiento y operación de las empresas de seguridad privada para que éstas funcionen y presten sus servicios de manera legal y legítima sin que éste servicio se constituya en una amenaza para la sociedad. Por último se analizaran cuáles son las infracciones en las cuales se pueden ver involucradas tanto las empresas de seguridad privada como el personal administrativo y operativo que las integra debido al incumplimiento de la ley y así poder conocer cuáles son las diversas sanciones que pueden ser aplicadas a las compañías de seguridad que estén operando al margen de la ley y así garantizar a la ciudadanía el poder contratar tanto en el ámbito público como privado con organizaciones de seguridad serias, legales y que brinden un servicio de vigilancia y seguridad de calidad. The development of this thesis basically begins with the study and analysis of the Constitutional Rules in force in Ecuador that guarantees and recognized security as a fundamental right and duty of the Central Government for its inhabitants in order that the citizenship can develop its skills, capacities and faculties in a secure and peaceful way where the common good is guaranteed. After analyzing the Constitution of the Republic will be analyzed and studied the procedures to the establishment of Limited Liability Partnerships and after this, we can understand in a better way which are the requirements, authorizations and permits that the Law of Surveillance and Private Security and its respective regulation requires for the legal constitution of Limited Liability Partnerships of Private Security in Ecuador. Overcome the constitution of the Limited Liability Partnerships of Private Security in Ecuador, will be studied and analyzed which are the organizations and institutions that control and regulate this activity with the purpose of to supervise and to control the work and operation of the private security companies to operate and provide their services in a lawful manner and legitimate without this private service becomes a threat to society Finally were analyzed the infractions in which the companies, the administrators and its operative staff can be involved due to the violation and breach of the law of Surveillance and Private Security and its own regulation. This way people will know which are the sanctions that can be applied to the Partnerships of Private Security that are working to the margin of the law and operating in an illegal way. By this way we will guarantee to the society to contract in the public or private area with serious and legal organizations of Private Security which offer its service of quality. |
