La abrumadora aprobación de la nueva Constitución en el año 2008, si bien respondía a un momento político electoral que tenía un fuerte respaldo de la figura política nacional más importante – el Presidente Correa -, también se debía a la incorporación de nuevos derechos al ordenamiento jurídico nacional. En dicho texto, se profundiza la democracia directa con el perfeccionamiento de la figura de la revocatoria del mandato para todas las autoridades de elección popular. La presente investigación pretende analizar con detalles los elementos históricos, jurídicos, políticos y sociales que confluyeron para que las distintas constituciones del mundo incorporen a la revocatoria como un derecho fundamental de los ciudadanos. Al mismo tiempo, realiza un estudio de la normativa nacional que configura una serie de regulaciones a la revocatoria del mandato, terminando por construir un esbozo de principios que de acuerdo a la Constitución y la doctrina, deberían regir a esta figura, que la consideramos garantía de la democracia. The overwhelming adoption of the new Constitution in 2008, at the same time responds to a political campaign which had strong backing from the major national political figure - President Correa - was also due to the incorporation of new legal rights to the national legislation. In the text, direct democracy is deepened with the improvement of the figure of the recall of all elected officials. The present research analyzes in detail the historical, legal, political and social elements that came together over the years for the various constitutions of the world defining the recall as a fundamental right of the citizenship. At the same time, this research makes a study of the national legislation that sets a series of regulations to recall the mandate, and also pretends to build an outline of principles which according to the Constitution and the doctrine should regulate this constitutional figure. |
