The aim of the essay is double: to understand the way in which they function, and to start a reflection on the necessity of improving the legislative technique through which they are designed. In addition, the article studies the "deroga-tion" of legal norms. In view of this, the operation of the legal system is analized, making a temporal distinction between diver-se sets of norms, on the basis of two criteria: belonging and validity. Número 102Septiembre - Diciembre 2001Nueva Serie Año XXXIVISSN 0041 8633 ARTÍCULOS TRANSITORIOS Y DEROGACIÓN Carla HUERTA OCHOA * En el presente artículo se aborda el tema de los artículos transitorios con el objeto de comprender su naturaleza, fines, límites y alcances como norma jurídica, no solamente para entender su funcionamiento, sino principalmente para inducir a la reflexión sobre la necesidad de aplicar una mejor técnica legislativa en su elaboración y límites a sus contenidos. Asimismo, se realiza un análisis de la derogación desde la perspectiva del sistema jurídico, para lo cual se revisa el funcionamiento del propio sistema haciendo una distinción temporal entre diversos conjuntos de normas a partir de los criterios de pertenencia y vigencia.
