Descripción: This paper addresses the issue of quality of the legal rule in relation with the updated knowledge of the subject that regulates, specifically on development planning of municipalities in Mexico. This article studies concepts and methodologies of strategic and participatory planning on municipal development planning, and it presents the characteristics of a legal standard of quality. Also, this paper presents a review of the constitutional text in democratic and strategic planning and in the Planning Act. Subsequently, it presents analysis of local political constitutions, organic municipal laws, the laws of citizen participation and planning laws at local level where it is analyzed whether the constitutional and legal text clearly indicates the planning methodology and whether encourages the citizen to participate on it, to know if there is sufficient quality in the legal framework. Lastly, the closing comments present the areas of opportunity detected in the analysis of the legal framework.
El presente trabajo aborda el tema de la calidad de la norma jurídica con relación al conocimiento actualizado de la materia que regula, específicamente sobre la planificación para el desarrollo en los municipios de México. Se estudian los conceptos y metodologías de planificación estratégica y participativa, y se presentan datos sobre la planificación para el desarrollo municipal, así como las características de una norma jurídica de calidad. Se hace una revisión del texto constitucional a nivel federal y de la Ley de Planeación. Posteriormente, se presentan análisis respecto de las Constituciones políticas locales, las leyes orgánicas municipales, las leyes de participación ciudadana y las leyes de planeación a nivel local donde se estudia si el texto constitucional y legal indica claramente la metodología de planificación y si incentiva a la participación ciudadana en la misma, con el objetivo de conocer si la norma se encuentra actualizada en cuanto a la materia que regula. Finalmente, se detectan las áreas de oportunidad en el marco jurídico analizado.
