En el artículo se pretende describir la ideología normativa presente en la motivación judicial del denominadoEstado Legislativo. Para cumplir dicho propósito se rastrearán las distintas acepciones sobrela denominación “motivación judicial”; se aportará una breve referencia histórica sobre la construccióndel mencionado concepto; se explicarán los postulados del Estado Legislativo y su relación con elsilogismo jurídico; y finalmente enunciará las razones de su desencanto o pérdida de hegemonía. Para lograrel fin propuesto, ahondará en las concepciones de justicia hegemónicas y sus presupuestos epistemológicos.AbstractThe article intends to describe the normative ideology present in judicial motivation called state legislature. Tofulfill that purpose will be tracked on the different meanings of the term “legal reasons”, shall be provided a briefhistorical background to the construction of that concept, we will explain the principles of the State Legislatureand its relation to the legal syllogism, and finally we will state the reasons of disappointment or loss of its hegemony.To achieve the intended purpose, we will delve into hegemonic conceptions of justice and epistemological |
