La división de grupos vulnerables, no entro en el Programa del Sistema de Protección de Víctimas y Testigos en el Ecuador; por esta razón, me propuse a investigar y a analizar cuáles son, y su papel en el desempeño, en la medida de protección, para eso utilicé la ayuda del Programa de Protección de Victimas que rige en Colombia, más la Constitución como base de garantía, y Leyes conexas. Mi trabajo está compuesto por cuatro capítulos, el primero es la evolución histórica del Ecuador en el tema de protección de víctimas y testigos, aquí hago un énfasis en cómo ha ido evolucionando las diferentes etapas históricas del reconocimiento del ser humano y su vida digna, más la creación de los Derechos Humanos, y otras garantías internacionales. El segundo capítulo es la competencia para aplicación del Programa y Asistencia a Víctimas, Testigos y Otros Participantes en el Proceso Penal aquí se define a la victimología, víctima, clases de víctimas, derecho de las víctimas, la victimización y el principio del sistema de protección y asistencia. El tercer capítulo trata sobre el servicio de protección y asistencia que ofrece el sistema, encontramos de dónde se deriva la medida de protección, sus clases, el trámite a seguir, su fundamento, la infraestructura, sus colaboradores y tiempo de duración. Para finalizar, el cuarto capítulo hago referencia en las víctimas especialmente vulnerables y su rol en la sociedad, en el marco legal, en el Programa de Protección y Asistencia a Víctimas y Testigos y Otros Participantes; cuáles son las políticas de protección, qué ofrece el Ecuador, la celebración de acuerdos que el Estado realiza con la víctima, las garantías de protección, la clase de asistencia y los medios alternativos de protección. Para concluir, acorde los delitos van evolucionando, también necesitan evolucionar las medidas de protección, Leyes y garantías necesarias de protección en el Ecuador The division of vulnerable groups, did not go on the Program System Protection of Victims and Witnesses in Ecuador, for this reason, I decided to investigate and analyze what they are, and their role in the performance, to the extent of protection, for that I enlisted the help of Victim Protection program in Colombia, the Constitution as a guarantee, and related laws. My work consists of four chapters, the first one is the historical evolution of Ecuador in the matter of protection of victims and witnesses, here I focus on what has evolved different historical stages of the recognition of human dignity and life, plus the creation of Human Rights and other international guarantees. The second chapter has an implementation of and Assistance to Victims, witnesses and other participants in the criminal process; it defines victimology, victim, types of victim, victim rights, victimization and the preamble of protection system and assistance. The third chapter deals with the protection and assistance service offered by the system, we find where it comes the measure of protection, their classes, the procedure to follow, its foundation, infrastructure, employees and duration. Finally, the fourth chapter I refer to particularly vulnerable victims and their role in society, in the legal framework, the Program for the Protection and Assistance to Victims and Witnesses and Other Participants, which policies of protection are offered by Ecuador, Arrangements that victims make with the State, the guarantees of protection, assistance and alternative means of protection. In conclusion, according with evolution of crimes, we also need the evolution in security measures, laws and necessary guarantees of protection in Ecuador. |
